CVC Liability Release Form
I ACKNOWLEDGE THAT BY AGREEING TO THE TERMS IN THIS WAIVER AND RELEASE OF POTENTIAL CLAIMS, I AM RELEASING OUT-SPOKIN/CONEJO VELO, INC., DBA CONEJO VALLEY CYCLISTS (“CVC”) AND CVC’S MEMBERS, AGENTS AND REPRESENTATIVES FROM LIABILITY. THIS APPLICATION AND RELEASE IS A CONTRACT WITH LEGAL CONSEQUENCES. I HAVE BEEN ADVISED TO READ IT CAREFULLY BEFORE AGREEING.
Please accept this as my application to join or renew my membership in OUT-SPOKIN/CONEJO VELO, INC., dba Conejo Valley Cyclists ("CVC").
I acknowledge that cycling is an inherently dangerous sport in which I participate at my own riskand that the CVC is a non-profit corporation formed to advance the sport of cycling, the efforts of which directly benefit me. In consideration of the agreement of the CVC to accept me as a member, hereby on behalf of myself and my heirs, spouse, children, estate, successors, assigns, insurers, and personal representatives, I release, hold harmless, and forever discharge CVC, its current and former employees, officers, directors, agents, members, sponsors, promoters, predecessors, successors, assigns, insurers and affiliates, and each of them, of and from any and all liabilities, claims, demands, damages, debts, accounts, causes of action, losses, costs and expenses "Claims", of every kind and nature whatsoever, whether now known or unknown, suspected or unsuspected, and waive and promise not to sue on any such Claims against any such person or organization, arising directly or indirectly from orattributable in any legal way to any negligence, action or omission to act of any such person or organization in connection with sponsorship, organization or execution of any bicycling ride, event or race, including travel to and from such event, in which I may participate as a rider, team member or spectator.
I acknowledge that unsafe and dangerous road conditions and other road hazards may be encountered during the course of a planned ride; I release, discharge and hold harmless CVC, its agents and representatives from any liability in connection with the organization, planning and execution of a ride route where injuries or losses are sustained as a result of unsafe road conditions or other road hazards.
I understand that, while CVC requires helmets to be worn on all rides, helmets must be fitted and worn correctly. I understand the wearing of a helmet does not protect me from all injury or death. I assume all responsibility and liability for selecting my (or my child's) helmet.
The provisions of this waiver and release of liability claims are severable. If any provision is held to be invalid or unenforceable, it shall not affect the validity of any other provision.
I agree to be added to all correspondence regarding Cruisin' the Conejo, CVC Racing, CVC Benefit Ride and Picnic, and any other cycling related events or activities and will be given the opportunity to unsubscribe from those correspondences.
